I. Position and function

           The Management Board of the Economic Zone of Quang Binh province (hereinafter referred to as the Management Board) is an agency directly under the People's Committee of Quang Binh province, performing the direct state management of industrial zones and zones. economic zones and border economic zones in the province (hereinafter referred to as industrial zones and economic zones) and organizations providing public administrative services and other supporting services related to investment activities and production and business for investors in industrial zones and economic zones.

           The Management Board is subject to the direction and management of organization, staffing, civil servants, public employees, work plans and operating costs of the provincial People's Committee; subject to the direction, guidance and inspection of professional expertise of ministries and branches managing branches and domains in the management of industrial parks and economic zones; is responsible for closely coordinating with specialized agencies under the Provincial People's Committee in the management of industrial parks and economic zones.

           The Management Board has legal status; have an account and a seal bearing the national emblem; to use State administrative management funds, non-business activities and development investment capital allocated by the State budget according to the annual plans; other funding sources in accordance with the law.

           The head office of the Management Board is located in Dong Hoi city, Quang Binh province.

II. Duties and powers

The Management Board performs the tasks and powers according to Article 2 of the Joint Circular No. 06/2015 / TTLT-BKHĐT-BNV dated September 3, 2015 of the Ministry of Planning and Investment and the Ministry of Home Affairs guiding the functions and tasks. divisions, powers and organizational structure of the Management Board of industrial parks, export processing zones and economic zones, including:

1. Submit to the Provincial People's Committee

a) Draft of documents defining the functions, duties, powers and organizational structure of the Management Board;

b) Draft documents specifying the conditions and criteria for titles for the heads and deputy heads of units under the Management Board;

c) Draft project on establishment and reorganization of Management Committees in accordance with law;

d) Regulation on coordination with specialized agencies under the Provincial People's Committee and other relevant agencies to perform assigned tasks and powers under the OSS mechanism;

dd) Draft planning project, adjusted and supplemented the planning for development of industrial zones and economic zones;

e) Annual and 5-year plans for development of industrial parks and economic zones, development of human resources and development investment capital;

g) Draft decisions, directives, documents; programs and measures to organize the implementation of state administrative reform tasks in the industrial sector and economic zones under the management of the Management Board according to law provisions.

2. Submit to the Chairman of the Provincial People's Committee

a) Draft decisions on establishment, merger, division, reorganization, dissolution of the organizations and units under the Management Board in accordance with law;

b) Draft of documents under the promulgation authority of the President of the provincial People's Committee on industrial zones and economic zones.

3. To assist the provincial People's Committee in managing the use of State budget capital to invest in the construction and development of industrial parks and economic zones;

4. Guide, inspect and organize the implementation of legal documents, master plans, plans, schemes, projects, mechanisms and policies on industrial parks and economic zones after they are promulgated and approved. Browser; information, propaganda, guidance, dissemination and monitoring of the implementation of the law on industrial parks and economic zones of the province.

5. Regarding investment management

a) Receive, issue, adjust, and revoke Investment Registration Certificates of investment projects within their jurisdiction in accordance with the law on investment;

b) Organize investment promotion activities according to the plans approved by the Ministry of Planning and Investment, Ministries, sectors and Provincial People's Committees; participating in investment promotion programs in industrial zones and economic zones organized by the Ministry of Planning and Investment, ministries, branches and provincial People's Committees; to guide and support investors according to their competence in the process of preparing and implementing investment projects; periodically report investment promotion activities to the Ministry of Planning and Investment and the provincial People's Committee according to the State management regulation on investment promotion;

c) Resolving difficulties and problems faced by investors, assessing investment efficiency in industrial parks and economic zones; quarterly, every 6 months and annually, send reports on investment activities and production and business activities in industrial zones and economic zones to the provincial People's Committee and the Ministry of Planning and Investment according to regulations.

6. Regarding environmental management

a) Organize the appraisal and approval of reports on environmental impact assessment for projects in industrial zones and economic zones as authorized by the People's Committee of the province (for projects under the authority of the Commission. Provincial People's Committee);

b) Receiving registration and certification of environmental protection plan for subjects subject to registration in industrial zones and economic zones as authorized by the provincial-level environmental agency and the People's Committee district-level people (for projects falling under the authority of district-level People's Committees);

c) Organize the appraisal and approval of detailed environmental protection projects, simple environmental protection projects of projects in industrial zones and economic zones as authorized by a competent authority;

d) Organize the inspection and certification of the completion of environmental protection works serving the project operation phase for investment projects in industrial zones and economic zones in accordance with the law on environmental protection.

7. Regarding the planning and construction management

a) Adjusting approved detailed construction plannings of industrial zones and functional areas in economic zones without changing the land use function and planning structure;

b) Appraise basic design of investment projects group B, C subject to appraisal in industrial zones and economic zones;

c) Granting, adjusting, extending, re-issuing, revoking work construction permits for construction works in industrial zones or economic zones requiring construction permits as decentralized or authorized by the Commission Provincial people;

d) Carry out tasks related to planning management and construction, and quality of works in industrial zones and economic zones in accordance with the law on construction and decentralization and authorization of competent authorities. .

8. Regarding labor management

a) Receive reports and explanations from enterprises in industrial parks and economic zones on demand for foreign workers for each job position that Vietnamese workers have not yet met, summarize, submit to the Chairman of the provincial People's Committee for decision as authorized by the provincial People's Committee;

b) Issuing, reissuing and revoking work permits for foreign workers working in industrial zones and economic zones; certifying that foreign workers working for enterprises in industrial zones and economic zones are not subject to work permits under the authorization of the Department of Labor, War Invalids and Social Affairs;

c) To organize the registration of the labor rule, to receive the collective labor agreement as authorized by the Provincial People's Committee; to receive registration of the system of salary scales, payrolls and labor norms of enterprises in industrial parks and economic zones as authorized by the district-level People's Committee;

d) Receive notifications of resignation of multiple employees, reports on labor outsourcing, results of annual training and retraining to improve professional qualifications and skills of enterprises in the industrial park, economic zones as authorized by the Provincial People's Committee;

dd) Receive and process applications for registration of performance of internship contracts from enterprises in industrial zones and economic zones, and activities of sending workers abroad under the form of lifting internships. highly skilled for a period of less than 90 days as authorized by the Department of Labor, War Invalids and Social Affairs;

e) To receive reports on labor use, reports on changes in labor; receive notices on the organization of enterprises working overtime from 200 hours to 300 hours a year in industrial zones or economic zones as authorized by the Department of Labor, War Invalids and Social Affairs;

g) Receive notification of the location, location, time of commencement of operation and the manager and person holding key titles of the labor outsourcing enterprise in industrial zones and economic zones as authorized by the Department. Labor, Invalids and Social Affairs;

h) Performing the tasks of labor management in industrial zones and economic zones, including: ensuring occupational safety, occupational hygiene, building labor relations, settling labor disputes, and suspending work according to the labor law or the guidance of the competent authority. 

9. About trade management

a) Grant, reissue, amend, supplement and extend licenses for establishment of trade representative offices of foreign organizations and traders located in industrial zones or economic zones under the guidance of the Ministry of Industry and Trade. Love;

b) Granting a business license, supplementing business objectives for sale and purchase of goods and activities directly related to the sale and purchase of goods to foreign-invested enterprises and foreign investors invest in industrial zones and economic zones in accordance with law, guidance of the Ministry of Industry and Trade and authorization of the People's Committee of the province;

c) Granting, re-issuing, amending and supplementing certificates of business eligibility and licenses for trading of a number of items under specialized management for traders who have head offices and have business establishments. in industrial zones and economic zones under the guidance of the Ministry of Industry and Trade;

d) Issue certificates of origin of goods manufactured in industrial zones and economic zones under the guidance and authorization of the Ministry of Industry and Trade.

10. Regarding land and real estate management

a) Receipt of registration of price brackets of land lease or sublease of land and infrastructure fees of industrial parks and economic zones of investors in construction and commercial operation of infrastructure of industrial parks and economic zones and their functions. and other tasks on real estate business management in accordance with law;

b) The Management Board of the economic zone shall perform the functions and tasks related to land specified in Article 151 of the Law on Land No. 45/2013 / QH13 and Article 53 of Decree No. 43/2014 / ND-CP dated May 15. / 2014 of the Government detailing and guiding the implementation of a number of articles of the Land Law.

11. Other duties and powers

a) To issue a number of types of permits and certificates in industrial zones and economic zones according to the competence, guidance and authorization of ministries, provincial People's Committees and competent agencies;

b) Implementation of international cooperation in the field of development of industrial zones and economic zones in accordance with the provisions of law and as assigned or authorized by the provincial People's Committee, the President of the provincial People's Committee;

c) Organizing research and application of scientific and technical advances; to build an information and archive system in service of state management and professional expertise in the assigned field;

d) To inspect and handle according to its competence or propose competent authorities to handle violations of the law in the fields of investment, environment, labor, commerce, and construction under its management. the State management is decentralized and authorized by the Management Board; to participate in inspection and organize the settlement of complaints and denunciations according to the provisions of law; implementing anti-corruption, practicing thrift and combating wastefulness;

e / To manage organizational apparatus, civil servant payrolls, civil servant rank structure, job position, public employee structure according to professional titles and the number of people working in public non-business units; implement salary regimes and policies, preferential treatment, training, retraining, commendation and discipline for civil servants, public employees and employees under the management of the Management Board in accordance with regulations of the Management Board. law and under the decentralization or authorization of the Provincial People's Committee;

e) Manage and take responsibility for the assigned finance and assets in accordance with the law;

g) Make information, report periodically and irregularly on the performance of tasks in the fields of work assigned to the People's Committee of the province, the Ministry of Planning and Investment and the Ministries and agencies involved. concerned; receive statistical reports and financial statements of enterprises operating in industrial parks and economic zones; to build an information system on industrial parks and economic zones in the province and connect with the national information system on industrial parks and economic zones;

h) Organize emulation and commendation movements for enterprises in industrial zones and economic zones;

12. Perform other duties and powers according to the provisions of law and the assignment and authorization of the Provincial People's Committee, the President of the Provincial People's Committee.
